Does anyone have experience with the seizure of IP addresses at RIPE?

Dear, we are the sponsoring LIR of a company that has a claim against a RIPE member in Germany. This claim was confirmed by court judgment through an enforcement order. As part of the compulsory enforcement, there is a garnishment and transfer order instructing RIPE to transfer the members IP addresses. However, RIPE refuses to comply and comes up with all sorts of ideas, e.g. that the creditor should first become a RIPE member, or that the whole matter must first be served to RIPE by a Dutch court, etc. Obviously, RIPE does not seem to care much about applicable EU law and legal proceedings. The lawyer now recommends suing RIPE, since they are not complying with the garnishment order, thereby making themselves liable for damages, and should then directly pay the claim against the RIPE member instead of releasing the IP addresses. That would, of course, be even easier, since nobody would have to deal with the sale of the IPs, etc. Has anyone here ever had any experience with this? Thread: https://mailman.ripe.net/archives/list/members-discuss@ripe.net/thread/RSMA… Hi Thomas, There is precedent in national courts treating IP addresses as attachable assets (e.g. *Amtsgericht Hamburg, case 67a M 93/19*, and *OLG Wien, case 3 R 195/14y*). The difficulty is that RIPE NCC, under Dutch law, considers them contractual “rights of use” and will only act on a *Dutch court order*. In practice, creditors either secure a voluntary transfer from the debtor or go through proceedings in the Netherlands. Without that, RIPE will not execute a garnishment. IPv6 is cheaper to implement, but the transition is a curse for admins. They don't understand it, because they only know 255. Companies should clean up their IPv4 networks. Fees should be fairer for members. We have costs that are rising with the maturity. Yes, perhaps a red line should be applied there. But we're all clear on this point, only because there is a membership charter, and it's not exactly fair. Members-Discuss Mailing List Placed Under Moderation

Dear members, In light of recent activity on the members-discuss mailing list, the Executive Board resolved to place the members-discuss mailing list in moderation until further notice. This follows numerous complaints that have been made about mails that are off-topic and/or contain material that does not show tolerance or respect for fellow members of the list. The resolution is: “The RIPE NCC Executive Board resolves to temporarily moderate the members-discuss mailing list starting from Monday 2 June 2025, 20:00 CEST and until further notice. The mailing list will be moderated in accordance with the purpose of the mailing list and the principles of the RIPE Code of Conduct by a designated member of the RIPE NCC Executive Board and a RIPE NCC staff member. All emails, accepted or rejected, will be archived on the RIPE NCC website.” The minutes of the Board meeting will be published soon. With this resolution, the principles of the RIPE Code of Conduct will be applied to the members-discuss list. Emails that do not meet the requirements of the code of conduct will not be approved to be posted to the list. Mails that do not meet the intended purpose of providing members with a means to discuss membership issues among themselves will also not be approved to be posted to the list. The moderators of the list will be the Executive Board Secretary and one member of RIPE NCC staff. Mails will be moderated during office hours. A separate archive of all mails, including those rejected by the moderators, is available for all members to view should they wish to do so. It's about fair distribution. And companies that earn millions should also understand that they have to do their share. And not just laugh and say, "Yeah, unfortunately, you came 30 years too late." You won't even be able to get started in the market. We need to come up with a new fee structure that is fair to all members. Yes, I'm exaggerating about the statement about millions. But it should be possible to even consider approaches to a fair model. Everyone should openly say how we could improve the model without being immediately punished by others. Suggestions are welcome. Just because the model is 30 years old doesn't necessarily make it good or fair. Suggestions are ideas, and they can be good, bad, or whatever. But that's what suggestions are about: the exchange of ideas and opinions. Just because I like chocolate ice cream the most doesn't mean everyone has to share my opinion. or even like ice cream.
