Indemnification of the RIPE NCC by its Members

Dear colleagues, At the General Meeting on 2 November 2011, a member expressed concerns regarding the former Article 7.6/current Article 8.6 of the Standard Service Agreement, which states: "The Member shall indemnify the RIPE NCC against any and all third party claims filed against the RIPE NCC in relation to the Member's use of the RIPE NCC services." It was suggested that this provision gives unlimited liability by the membership to the RIPE NCC and, consequently, unlimited financial backing of the RIPE NCC by the members. It was said that the RIPE NCC should not ask all members to guarantee its liability in an unlimited way and it was suggested that the provision be amended as soon as possible. The RIPE NCC reviewed the provision and came to the following conclusion: This provision requests that the member must indemnify the RIPE NCC if: - A third party files claims against the RIPE NCC; and - These claims refer to this member's use of the RIPE NCC's services If the claim refers to a particular member's use of the RIPE NCC's services, then no other member has an obligation to indemnify the RIPE NCC. The aim of the provision is that an individual member should indemnify the RIPE NCC against a third party claim against that individual member. The indemnification does not carry beyond these parties (the RIPE NCC and the specified member). If a member infringes a third party's rights through the use of the RIPE NCC's services, then this member is liable for their own actions. If the RIPE NCC could not require such indemnification, then the RIPE NCC itself (i.e., the whole membership) could be obliged to compensate any third party for illegal activities of a certain member. Under legal advice, the RIPE NCC has decided to retain the clause in its current form. If a claim is filed against the RIPE NCC, the penalty or compensation can be passed on to the member specified in the claim, leaving other members unaffected. In order to comply with this mandate, the RIPE NCC performs due diligence on organisations the RIPE NCC registers Internet number resource for. This document outlines the minimum information and documentation the RIPE NCC requires to make sure that the registration data is valid and up-to-date. Transfer of Internet Number Resource Records and Change of a Member’s Official Legal Name - Draft Document

Dear colleagues, The RIPE NCC has created a draft procedural document, “Transfer of Internet Number Resource Records and Change of a Member’s Official Legal Name”. A PDF of the document is available at: http://www.ripe.net/lir-services/ncc/legal/Transferofrecords_namechange.v20… The draft document refers to the current procedures the RIPE NCC follows in order to maintain an accurate registry in the case of changes regarding: - The Internet number resource records that are registered to a person; or - The official name of the person holding a registration of Internet number resources The procedures were originally discussed at the RIPE 62 Meeting in Amsterdam. The text of this document is intended to replace relevant sections of ripe-515, “Mergers, Acquisitions, Takeovers and Closures of Organisations Operating an LIR”. Proposal for New RIPE NCC Charging Scheme Model

Dear Colleagues, In recent years, there has been much discussion about the RIPE NCC Charging Scheme. The RIPE NCC Executive Board welcomes this feedback and has followed the discussion on the members-discuss mailing list and at RIPE NCC General Meetings. A Charging Scheme Task Force was established with representatives from different membership categories, as well as members of the RIPE NCC Executive Board and RIPE NCC staff, in order to provide recommendations for updating the Charging Scheme model. In response to the feedback from members and the Charging Scheme Task Force, the RIPE NCC Executive Board has developed a proposal for a new Charging Scheme model. In very broad terms, this model creates a simplified fee structure where the majority of members pay the same fee. The income derived from these membership fees covers the majority of the RIPE NCC’s operational costs. The proposal is available at: www.ripe.net/lir-services/ncc/gm/september-2012/ We have produced this proposal in answer to members’ discussion of the current Charging Scheme model and by following, as closely as possible, the recommendations of the Charging Scheme Task Force. The purpose of publishing this proposal now is to encourage RIPE NCC members to look at the proposed new model and to give their feedback. The Executive Board will be meeting again in early August 2012 to finalise the proposal that will be presented for a formal vote at the RIPE NCC General Meeting 2012. We urge you to send us any comments or concerns you have about the proposed model by the end of July. Database Updates service recovery

Dear Colleagues, The issues with our RIPE Database update services is resolved. All mail sent during the downtime is now processed and sync updates, web updates and API updates are back to normal. If you experience any problems, please contact ripe-dbm(a)ripe.net. The update service was down between 07:58 CET (05:58 UTC) until 9:55 CET (07:55 UTC) due to hardware issues. Database Updates service disruptions

Dear Colleagues, RIPE Database sync updates, web-updates and API updates are not responding at the moment. We are dealing with hardware problems on the machines used for the database update cluster. The service was affected from from 07:58 CET (05:58 UTC) and we are working to recover it as soon as possible. Queries will keep working and updates via emails are queued and will be processed as soon as the service is up. Resource Certification (RPKI) reaches 1000 LIR landmark

Dear colleagues, Today, 18 months after launching the RIPE NCC Resource Certification (RPKI) service, the 1,000th LIR has requested a digital certificate for their Internet number resources. The service has come a long way, from a prototype developed in 2006 to a full production service in collaboration with the other Regional Internet Registries, aimed at making the RIR Registries more robust and BGP routing more secure. Resource Certification offers LIRs validatable proof of holdership. In addition, it allows LIRs to make cryptographically verifiable statements about which Autonomous Systems are authorised to originate the IP prefixes they hold. The toolset developed by the RIPE NCC to validate and use this data has been downloaded hundreds of times in the last months and is actively used by many organisations to make better BGP routing decisions. Royal Honour Bestowed on Kees Neggers, Former RIPE NCC Executive Board Chairman

[Apologies for duplicate emails] Dear colleagues, On 20 June 2012, Kees Neggers, who served on the RIPE NCC Executive Board from 1999 to 2008, was made an Officer in the Order of Orange Nassau (Orde van Oranje Nassau). The royal honour was bestowed by the Mayor of Heumen at a symposium for Kees's outstanding contribution to Dutch society. During his tenure as Chairman of the RIPE NCC Executive Board, Kees ensured the strong involvement of Europe in the administration of the Internet worldwide and the Netherlands’s continued position as a centre of excellence for the Internet industry. He oversaw the administration of the Internet in over 100 countries in Europe, Africa, the Middle East and parts of Central Asia. It was during his tenure on the RIPE NCC Board that Africa was able to establish its own RIR to be become one of the five organisations managing Internet number resources in the world today. Kees has always ensured that the Netherlands was involved in the task forces that drove the development of the Internet globally. He led the involvement of SURFnet and other Dutch technology companies in sharing best practices and experiences with similar organisations around the world. He has always been a strong advocate for the principles of open, inclusive and bottom-up industry self-regulation. It is these very principles that still guide RIPE, the RIPE NCC, TERENA and others that contribute to the successful management of the Internet globally. Kees Neggers is one of the most influential figures in the Internet community. He was instrumental in shaping the model that is currently used to manage the global IP address system.
