RIPE NCC GM Agenda, Activity Plan, Budget and Charging Scheme

Dear Colleagues, The RIPE NCC service region is very diverse and includes a wide variety of regions, languages and economies. The RIPE NCC Executive Board makes every endeavour to position the RIPE NCC so that it can deliver the highest level of service to the more than 8,000 members across its service region. We are elected by those members to represent their interests and to ensure that the organisation performs activities that meet their needs. Over the last year, the Executive Board has thoroughly examined the activities performed by the RIPE NCC. In particular, we have focused on analysing these activities in relation to the detailed feedback we have received from the membership and in light of changing conditions affecting the Internet industry. We have also made a sustained effort to develop alternative charging models through which the activities performed on behalf of the membership are covered by the annual service fees paid by the members. During this process, we have tried to incorporate the feedback that we have received from you. In addition to following the discussions taking place on the members’ mailing list and at RIPE Meetings, we commissioned an independent survey that generated valuable feedback. We also made sure to respond to comments and criticisms we received at recent RIPE NCC General Meetings. The results of these efforts are the Draft RIPE NCC Activity Plan and Budget 2013 and the proposals for the RIPE NCC Charging Scheme 2013. DRAFT ACTIVITY PLAN AND BUDGET 2013 As a result of your feedback about the previous Draft Activity Plan and Budget, we have provided a simpler format with a much clearer connection between the proposed activities and corresponding budget figures. We hope this will provide you with a quicker and more transparent way to assess the activities performed by the RIPE NCC on your behalf. We would like to point out some of the key strategic areas in the Draft Activity Plan and Budget 2013: - The Registry: There is a sharp focus on maintaining and developing the registry to ensure it remains robust and that the data it contains is accurate. Resource Certification (RPKI) is continuing to be developed with an emphasis on ensuring operator autonomy. - Services: Effort has been put into developing RIPEstat, a service that provides RIPE NCC members with information about the history and current state of any IP number resource. We are also proposing to put significant efforts into RIPE Atlas, a unique tool that enables users to measure how packets actually travel around the Internet. - Coordination Activities: In recent years, the RIPE NCC has taken an increasingly active role in reaching out to governments, regulators and other public bodies, such as law enforcement. This is vital for the RIPE NCC membership and the RIPE community as it enables the RIPE NCC to influence a range of public and intergovernmental bodies and to promote the success of the self-regulatory model of the Internet. It is difficult to over emphasise the importance of this work if we wish the Internet to continue in the form in which we know it. CHARGING SCHEME 2013 PROPOSALS The Executive Board is proposing three charging scheme options for RIPE NCC members to consider, discuss and vote on at the General Meeting. The options can be summarised as follows: Option A – Under this option, there are no categories and every LIR pays the same fee Option B – Based on the model presented to the membership in July 2012, which includes self-determination of billing categories for 2014 Option C – Based on the current Charging Scheme model with modifications to the billing score algorithm to include IPv6 and remove the separate charge for AS Numbers The three options are presented to the membership in order to address the wide range of ideas and concerns raised by the membership in recent discussion of the Charging Scheme model. The RIPE NCC Executive Board is eager to give members the opportunity to vote for the Charging Scheme model they prefer. The Executive Board presented a draft model to the membership in July 2012, and we firmly believe that this is the model (Option B) that most fully incorporates the recommendations of the Charging Scheme Task Force and is best placed to provide stability for both the RIPE NCC and its members in the years to come. Electronic Voting for the RIPE NCC General Meeting September 2012

Dear colleagues, At the upcoming RIPE NCC General Meeting (GM) in Amsterdam on 26 September 2012, electronic voting for the GM will be facilitated. Those attending the GM on site can vote either electronically or by using the traditional paper ballot method. A summary of what you need to do to register for electronic voting is provided at the end of this email. The voting period will begin after the resolutions are presented to the membership on 26 September and will remain open until 27 September at 14:00 (UTC +2). The voting period will give members in all time zones in the RIPE NCC service region adequate time to cast their votes. The RIPE NCC uses BigPulse, a third party that specialises in web-based voting solutions, to conduct the poll. Today, 22 August 2012, you will receive an email from the RIPE NCC inviting you to register for electronic voting with the BigPulse system. You should follow the instructions in the invitation email if you wish to register for electronic voting. The deadline to register for electronic voting is 25 September 2012. Those attending the GM in person who wish to vote electronically must also register by 25 September. NOTE: It will not be possible to register to vote electronically on the day of the GM. If you think you are entitled to vote but do not receive the invitation to register by 18:00 (UTC) on 23 September, please contact <agm(a)ripe.net> to let us know. The term of Dave Wilson, who was elected to the NRO NC in January 2009, ends on 31 December 2012. The election to the NRO NC seat will take place during the Plenary at the RIPE 65 Meeting to be held in Amsterdam from 24-28 September 2012. All members of the Internet community who are present at that Plenary may vote in the election. The deadline for nominations is 28 August 2012. Any individual residing within the RIPE NCC service region is eligible for nomination, except Regional Internet Registry (RIR) staff members. Self-nominations are permitted. RIPE NCC General Meeting September 2012 - Registration Open

Dear RIPE NCC member, The RIPE NCC Executive Board is pleased to invite you to the RIPE NCC General Meeting (GM) September 2012. The GM will begin on Wednesday, 26 September. It will be held adjacent to the RIPE 65 Meeting, which takes place from 24-28 September. You can register to attend the GM online at: http://www.ripe.net/gm-sept2012/registration Please complete the online registration as soon as possible. The GM will consist of two parts: - The RIPE NCC Services Working Group will begin at 16:00 (UTC +2) and will include the presentation of the Report from the RIPE NCC. This part of the GM is open to everyone. - The second part of the GM follows immediately after and is open only to RIPE NCC members who have registered for the GM. This part of the meeting is the forum where RIPE NCC members can discuss the operations and activities of the RIPE NCC and exercise their voting rights. At this GM, members will vote on the proposed Charging Scheme 2013 and will discuss the draft RIPE NCC Activity Plan and Budget 2013, which will be published in due course. For the GM, there will be electronic voting for the resolutions. The voting period will begin on Wednesday, 26 September according to the GM agenda and will remain open until 14:00 (UTC +2) on Thursday, 27 September. The Chairman of the Executive Board will then announce the results of the votes on the GM resolutions. Dear colleagues, The RIPE NCC has published a new version of the procedural document “Independent Internet Number Resources – Contractual Relationship Changes Between Sponsoring LIR and End User”. This document replaces RIPE Document ripe-516. The procedural document describes the modifications that could be made to a contractual relationship between a sponsoring Local Internet Registry (LIR) and an End User of independent Internet number resources, and the possible consequences of such changes or of failure to communicate these changes to the RIPE NCC. Indemnification of the RIPE NCC by its Members

Dear colleagues, At the General Meeting on 2 November 2011, a member expressed concerns regarding the former Article 7.6/current Article 8.6 of the Standard Service Agreement, which states: "The Member shall indemnify the RIPE NCC against any and all third party claims filed against the RIPE NCC in relation to the Member's use of the RIPE NCC services." It was suggested that this provision gives unlimited liability by the membership to the RIPE NCC and, consequently, unlimited financial backing of the RIPE NCC by the members. It was said that the RIPE NCC should not ask all members to guarantee its liability in an unlimited way and it was suggested that the provision be amended as soon as possible. The RIPE NCC reviewed the provision and came to the following conclusion: This provision requests that the member must indemnify the RIPE NCC if: - A third party files claims against the RIPE NCC; and - These claims refer to this member's use of the RIPE NCC's services If the claim refers to a particular member's use of the RIPE NCC's services, then no other member has an obligation to indemnify the RIPE NCC. The aim of the provision is that an individual member should indemnify the RIPE NCC against a third party claim against that individual member. The indemnification does not carry beyond these parties (the RIPE NCC and the specified member). If a member infringes a third party's rights through the use of the RIPE NCC's services, then this member is liable for their own actions. If the RIPE NCC could not require such indemnification, then the RIPE NCC itself (i.e., the whole membership) could be obliged to compensate any third party for illegal activities of a certain member. Under legal advice, the RIPE NCC has decided to retain the clause in its current form. If a claim is filed against the RIPE NCC, the penalty or compensation can be passed on to the member specified in the claim, leaving other members unaffected. The document is available at: https://www.ripe.net/ripe/docs/due-diligence The RIPE NCC has a mandate from the RIPE community to keep an up-to-date and correct Internet number resource registry. In order to comply with this mandate, the RIPE NCC performs due diligence on organisations the RIPE NCC registers Internet number resource for. This document outlines the minimum information and documentation the RIPE NCC requires to make sure that the registration data is valid and up-to-date.
