As the recent RIPE 81 meeting did not allow for a lot of time to talk about this topic, I have written a blog post to provide you with some updates and on what is happening within the realm of ITU. Apart from a change in terminology, there hasn't been much progress with regards to New IP. But equally important is that a further postponement of the World Telecommunication Standardisation Assembly (WTSA) is now on the table, with India proposing to reschedule the meeting to March 2022. Sneak preview for today's WG session

Dear WG, few weeks ago I had a reason to look into regulators' practices regarding net neutrality and then found something that could be of interest to the RIPE community (again). First, a little bit of background: there is an EU regulation 2015/2120 <https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32015R2120> that deals with 'net neutrality'. Then, there is BEREC <https://berec.europa.eu/>, the 'Body of European regulators for Electronic Communication', which is where the EU member states' telco regulators meet and coordinate. BEREC is where guidelines for dealing with 2015/2120 were written and it's also tasked with collecting the national regulators' reports and compiling these into a Report on the implementation of Regulation (EU) 2015/2120 and BEREC Net Neutrality Guidelines <https://berec.europa.eu/eng/document_register/subject_matter/berec/reports/…> Find all this and more at <https://berec.europa.eu/eng/open_internet/>. (The WG had dealt with the regulation and guidelines in mid 2016 already.) The most recent report says: 11 NRAs stated that they also undertook some other actions [...] creation of an IPv6 task force to accelerate the transition to IPv6 by enabling participants (ISPs, hosting companies, businesses, public sector players, etc.) to tackle specific problems and share best practices; and FI: The NRA has obliged operators to inform consumers about their right to a public IPv4 address in its memorandum about the Regulation. There's a number of other NRAs dealing with the (in)availability of public IPv4 addresses for end customers: Austrian regulator states that 'IPv6 penetration across the whole Internet currently at approx. 25%'; Slovenia reports: IPv4 address translation prevents traffic originating on the internet towards the user, which could be an issue if the user wanted to use its mobile terminal as an access point for a bigger number of devices connected at their home Netherlands' regulator ACM states: 2.3 Exploring the transition to IPv6 in the Netherlands BEREC has shown interest in making the transition from IPv4 to IPv6, a new standard for the use of IP addresses. The number of available IPv4 addresses has been depleted, but the introduction of IPv6 could lead to new problems. It appears there are differences between countries in how diligently the market and government organizations are currently dealing with the transition to IPv6. BEREC wishes to assess whether or not the roll-out of IPv6 (or the delay thereof) could lead to net neutrality issues. The French report has extensive coverage of IPv6. While 'net neutrality' is only one angle, it might be instrumental to note what issues get the attention of regulators and what the rationale is. See you at 14:00 CET in meetecho! -Peter

RIPE NCC contributes to consultation on NIS Directive

Dear colleagues, The RIPE NCC responded to the European Commission’s open consultation on the review of the Directive on Security of Network Information Systems (NIS Directive), which closed on 2 October. Specifically, we encouraged the European Commission to develop better definitions, in cooperation with the technical community, for the terms described in Annex II of the NIS Directive, including such terms as “network and information systems”, “operator of essential services”, "digital service provider” and more. We contribute to these kinds of consultations, both at the EU level and across the RIPE NCC’s service region, in order to provide technical expertise to policymakers and to promote a multistakeholder model of Internet governance. Invitation to IGF survey and workshop on Internet standards deployment

Dear reader, The deployment of Internet security-related standards and ICT best practices is a topic that continues to be the subject of important discussion worldwide with the aim of achieving a more secure and safer online environment that is necessary to support the rapid adoption of new digital technologies. This has been made even more urgent by the COVID-19 pandemic. I am sure you would agree that it is time to move on from what has been largely an uncoordinated and technical debate spread across various fora, and initiate global stakeholder cooperation that will have a positive impact on economic and social well-being through helping digital technologies to transform everybody’s daily lives. As you may know, the UN Internet Governance Forum is establishing a new Dynamic Coalition on Internet Standards, Security and Safety (DC-ISSS) with the aim of achieving this objective and I am now writing as the leader of this initiative to invite you as a leading expert to join this important multi-stakeholder coalition. The intended outcomes of the DC-ISSS will be recommendations for actions by key policymakers and decision-takers that will enable security-related Internet standards and best practices to be deployed more rapidly and with greater determination and commitment. By involving stakeholders like yourself we believe that we can at last make a difference in making deployment more effective and widespread. It has to stop to be a, primarily, technical debate, to be changed into an Internet healthcare topic. As a first step, the coalition needs to prioritise its work and finalise its work plan. A preparatory session for this purpose will be held during the upcoming IGF 2020 on Wednesday 4 November at 09.40 – 11.10 CET. A short questionnaire has been drawn up to help with this process. It would be appreciated very much if in addition to considering the invitation to join the coalition, you could complete this questionnaire which can be accessed at: https://survey.sogosurvey.com/Survey1.aspx?k=SsQYPPXWsRsPsPsP&lang=0. Our deadline for responses in 7 October. It does not take up more of your time than five minutes at a maximum. RIPE NCC view on the upcoming Digital Services Act

Dear colleagues, The European Commission is expected to put forward a proposal for a Digital Services Act (DSA) later this year. This package of legislation is meant to replace and update the E-commerce Directive of 2000. At the moment the Commission is holding an initial open consultation to gather feedback from its stakeholders and, importantly, the Internet industry. The RIPE NCC is preparing a response to the questionnaire that is part of this consultation and we urge you to do the same. However, as a player in the larger Internet ecosystem with a long history of contributing to Internet development, we also feel we're in a position to provide some more high-level feedback. This includes what we see as the major issues that need to be addressed and the possible implications of this wide-reaching legislative proposal for the technical layers of the Internet. While we are submitting this statement as the RIPE NCC (not explicitly on behalf of the RIPE community), we are interested to hear your views on it. Participation in ENISA survey on OTT communication and collaboration services

For this, ENISA has partnered with Plum Consulting to undertake a study, having as a goal is to better understand the security environment for OTT collaboration services and also gather information about the resilience of those services in the face of a variety of risks and threats. MoU between RIPE NCC & CITC

Online discussion: What Does the Digital Services Act Mean for You?

New Open Consultations by BEREC (access sharing, 5G and co-investment)

Dear colleagues, We'd like to draw your attention to a number of ongoing consultations with the Body of European Regulators for Electronic Communications (BEREC). BEREC's task is to further refine the implementation of European legislative instruments by issuing guidelines that support a consistent and harmonised approach across all member states. As with other institutions, BEREC's work has moved fully online, which makes consultations like this even more important as a way to liaise with stakeholders and receive feedback. The following consultations might be of interest: - Guidelines on the criteria for a consistent application of article 61 (3) EECC (deadline 31 July) Article 61 (3) of the European Electronic Communications Code has a number of provisions on sharing access infrastructure. In particular, this consultation addresses two key points. The first is about imposing obligations to share access infrastructure on entities which are not designated to have significant market power. The second involves sharing infrastructure beyond the first concentration or distribution point, to an interconnection point where the number of customers becomes more efficient and economically feasible. https://berec.europa.eu/eng/news_consultations/ongoing_public_consultations… - Guidelines to foster the consistent application of the criteria for assessing co-investments in new very high capacity network elements (Article 76 EECC) (deadline 4 September) We've already flagged the work on very high capacity networks in earlier emails. These particular guidelines lay out some specifications under which parties with significant market power (SMPs) may offer co-investment on new infrastructure and under which circumstances this would affect the obligations of the SMP under article 68 of the EECC. Our understanding is that, under certain conditions, such a co-owned infrastructure would not be subject to the regular obligations, such as infrastructure sharing and/or regulated tariffs, that would normally apply to SMPs. In our assessment, this could impact smaller operators that rely on such sharing arrangements and obligations. https://berec.europa.eu/eng/document_register/subject_matter/berec/public_c… - Guide to the draft BEREC Guide to the BEREC 5G Radar and 5G Radar (deadline 4 September) This consultation is part of the ongoing work to get a better understanding of the regulatory issues that might emerge from the deployment of 5G. Southeast Europe Country Report and Online Discussion

Dear colleagues, We’ve published the latest in our series of country reports, this time shining the spotlight on eight different countries in Southeast Europe. This is the fourth such country report that the RIPE NCC has produced as part of an ongoing effort to support Internet development throughout our service region by making our data and insights available to local technical communities and decision makers alike. The report takes stock of the current IPv4 and IPv6 resource holdings in the Southeast European region, looks at the history of development of the Internet industry, and assesses its opportunity for future growth. We also examine the region’s access to the global Domain Name System (DNS), look at how traffic is exchanged within the region, and identify the different paths and operators providing access from the rest of the world. While most of the press is about washing hands and infection rates and self-isolation and deaths there are other stories. This following story from the Guardian quotes our colleague Alexander Isavnin of the Internet Protection Society on what is happening in Russia. << One attempt has already sparked a backlash: a clumsy mobile application developed by Moscow’s city government to monitor coronavirus patients’ movements. The app, called Social Monitoring, was discovered last week in the Google Play store and requested access to a user’s location, camera, telephone, sensors and other data to ensure they were complying with quarantine. Social Monitoring quickly disappeared from the online store. Eduard Lysenko, the head of Moscow’s Department of Information Technologies, called the application a “test version” released for professional feedback. It would be re-released, he said, and those opposed to installing the app on their phones could opt to receive a temporary device instead. Lysenko also said that Moscow is ready to roll out QR codes that would require Muscovites to register online and reapply each time they sought to leave the house. Citizens will be required to “register, fill out a simple form and a corresponding code will be generated, which can either be put on a telephone, sent by mail, or printed,” he said. During the COVID-19 pandemic, criminals have been quick to seize opportunities to exploit the crisis by adapting their modi operandi and engaging in new criminal activities. Cybercriminals have been among the most adept at exploiting the pandemic. The threat from cybercrime activities during the crisis is dynamic and has the potential to increase further. With a record number of potential victims staying at home and using online services across the EU, the ways for cybercriminals seeking to exploit emerging opportunities and vulnerabilities have multiplied. Europol has been monitoring the impact of the COVID-19 pandemic on the cybercrime landscape since the beginning and has published an updated threat assessment of potential further developments in this crime area. The findings of this report are mainly based on contributions from EU Member States and Europol's partner countries. Main findings: * The impact of the COVID-19 pandemic on cybercrime has been the most visible and striking compared to other criminal activities. * Criminals active in the domain of cybercrime have been able to adapt quickly and capitalise on the anxieties and fears of their victims. * Phishing and ransomware campaigns are being launched to exploit the current crisis and are expected to continue to increase in scope and scale. * Activity around the distribution of child sexual exploitation material online appears to be on the increase, based on a number of indicators. * Both criminal organisations, states and state-backed actors seek to exploit the public health crisis to advance geopolitical interests. Impact of COVID-19 measures on operations and regulatory barriers?

Dear colleagues, With people in a large part of our service region now confined to their homes, it means that our societies and economies even more than ever depend on the Internet. Which has raised questions and concerns regarding the scalability and stability of our networks. Of course, we are doing our best to analyse data from RIS, RIPE Atlas and other sources to see what is going on and determine if there are any major changes related to the increased load or the limited movement of people and workers. Our colleagues from the European Commission, as well as a number of national regulatory agencies, have reached out to us, asking if we see anything different or have noticed any deterioration of Internet connectivity. Some have also inquired about any bottlenecks (particularly regulatory) we or the community are experiencing because of the unprecedented measures taken. As the RIPE NCC, one way we serve the community is to help inform policymakers of developments or concerns in the RIPE community. So in case you experience or expect any bottlenecks in your operations coming from existing regulation or any emergency measures, please feel free to post them here or contact us directly and we can relay those back to the team at the Commission or other relevant regulatory bodies we’re in contact with. BEREC seeking input on "Very High Capacity Networks”

Dear colleagues, The Body of European Regulators for Electronic Communications (BEREC) has announced that it will launch the public consultation on the definition of "Very High Capacity Networks" earlier than planned. The consultation will be launched during a public debriefing, which will be held on 10 March in Brussels. This work is related to the implementation of the new European Electronic Communications Code (EECC), which introduces the concept of "Very High Capacity Networks" (VHCNs) in relation to the use of fiber optic networks and connectivity via mobile networks. The EU Directive 2018/1972, in article 82, instructs BEREC to issue a set of guidelines for the criteria that a network should fulfill to be classified as a VHCN, including in terms of down and uplink bandwidth, resilience, error-related parameters, and latency. This definition will then be used in other aspects of the directive, for example with respect to the building and licensing of those networks by commercial operators as well as in relation to public/private partnerships and co-investment options. At this stage, the RIPE NCC does not plan to contribute to this consultation process, but we encourage you to evaluate whether you wish to contribute on your behalf. Of course, if there is community consensus within this group, we could submit a response in our role as secretariat on behalf of the RIPE community. Feel free to comment publicly on this list if you wish to share your views. Please note that we recently contributed to a similar consultation on guidelines regarding the definition of adequate broadband access service, making the case that IPv6 should be an integral part of any Internet access service. New on RIPE Labs: Our Response to the UN High-level Panel on Digital Cooperation Report

Dear colleagues, Some of you may be aware of the report released by the UN Secretary-General’s High-level Panel on Digital Cooperation in June, titled "The Age of Digital Interdependence”. The report lays out a set of three different proposals for advancing global digital cooperation, one of which is an “IGF Plus” model. Given our long involvement with the existing IGF and our vested interest - as part of the Internet technical community - in maintaining a multistakeholder approach to Internet governance, the RIPE NCC has submitted a formal response to the UN panel's report through EuroDIG’s and the IGF’s dedicated channels.
