Dear all, RIPE 90 ended with a total of 648 attendees checked in onsite in Lisbon and 172 checked in online across the meeting week, with more joining in via the livestream and YouTube. Thank you all for making this RIPE Meeting such a success! We were happy to see active participation at this meeting from both online and onsite participants. We would like to thank all the speakers, Working Group Chairs, the Programme Committee, the Code of Conduct Team and our sponsors for their contributions. Statement on Legal Threats

Dear Lu, all, We would like to respond to the statements you have made, here on the RIPE mailing list and at our General Meeting which took place on Wednesday. You commented that a lawsuit “could potentially cost millions”, and that we could "get out of this pretty easily" by allowing Internet number portability. For the record, the lawsuit you have threatened regards our decision not to accept sponsorship from you for the RIPE 90 Meeting. Of course, we disagree with the statements you have made. And we make the following statement in reply. The RIRs play a crucial role in ensuring the uniqueness of Internet number resources, which is essential for ensuring the operation and stability of the Internet. This role requires an authoritative source to prevent conflicts and overlaps in address allocations. In filling this role for our region as the RIPE NCC we make great efforts to maintain robust corporate governance with high levels of transparency. The RIR system has been developed by the technical community over more than three decades, through a process of open, transparent and bottom-up dialogue and policy development. Any significant changes to this system or the way we operate should be worked out through this well-established community process. We would also like to clarify that IP addresses are not property. This is reflected in the RIPE NCC Standard Service Agreement: “10.2 The Member acknowledges and agrees that the registration of Internet Number Resources does not constitute property and the registration of Internet Number Resources in the name of the Member or a third party does not confer upon the Member or the third party any rights of ownership. The Member acknowledges that any Internet Number Resources deregistered by the RIPE NCC may be re-registered to another party according to the RIPE Policies.” Let us be very clear - we stand behind doing the right thing for our members and community. A public statement was made that a legal threat regarding event sponsorship will go away if the RIR system accommodates someone’s personal interests. We believe that this legal threat is made without any solid basis and is intended merely to force the hand of the RIPE NCC in an aggressive manner. We suggest that if you believe the RIRs should implement number resource portability in a way that is not currently allowed by the existing policies, then you should follow the existing and well-established community policy processes that have allowed the RIRs to operate for many years in service to the wishes of their respective communities. It prevents scenarios where a member feels wronged without being heard, which often lead to lawsuits. • Appeal and Conflict Resolution: Mechanisms (arbitration, appeals committee) for independent review of RIR decisions. This gives members confidence that they can challenge decisions internally. It helps resolve disputes amicably and demonstrates accountability, making regulatory intervention less necessary. • Transparency and Accountability: Open publication of registries, policies, and decision-making processes, plus member governance of the RIR. This sunlight deters anti-competitive behavior and ensures community oversight. The same applies to the other four regional Internet registries (RIRs). It follows that RIPE NCC is obliged to act in line with EU competition law: * - *as an association of undertakings, it must comply with Article 101(1) of the Treaty on the Functioning of the European Union (TFEU), which prohibits decisions by associations of undertakings which may affect trade between Member States and which have as their object or effect the prevention, restriction or distortion of competition within the internal market of the European Union. This updated document is titled “Governance Document for the Recognition, Maintenance, and Derecognition of Regional Internet Registries” (RIR Governance Document) and can be viewed here: https://www.nro.net/policy/internet-coordination-policy-2/rir-governance-do… We now invite your input on this draft. Please make sure to share your feedback by Tuesday, 27 May 2025 on your regional consultation list. ----------------------------------------- Background Information ----------------------------------------- In October 2023, the Number Resource Organization Executive Council (NRO EC) asked the NRO Number Council (NRO NC), that fulfils the role of the Address Supporting Organization Address Council (ASO AC), to establish and manage a process to update the Internet Coordination Policy (ICP-2): Criteria for Establishment of New Regional Internet Registries document [1]. Modification of ICP-2 requires an open and transparent process to allow participation from across the global RIR and ICANN communities. As part of this process, the NRO NC invited the global Regional Internet Registry (RIR) communities to provide feedback on each principle via a questionnaire, which was open from 8 October until 6 December 2024 [2]. On 24 February 2025, the NRO published a qualitative analysis and summary of the community responses received on the proposed principles to update ICP-2 [3]. The updated criteria will continue to reflect the fundamental principles required for recognizing and evaluating new RIRs in keeping with the Internet landscape of today. There is no intention to fundamentally change or redesign the existing RIR system. The focus of the review and revision process is to identify existing gaps and areas of improvement to support the continued stability and self-governance of the Internet Numbers Registry System. This includes expanding or adding details related to governance, ecosystem, life cycle, recognition and operation of RIRs. It also outlines principles for the potential ‘derecognition’ of an RIR if it fails to adhere to the established criteria. ----------------------------------------- Share Your Input ----------------------------------------- The NRO NC is now seeking community input on the new draft text of the proposed “RIR Governance Document”. This feedback will be reviewed by the NRO NC during their workshop scheduled during ICANN 83 in June. Notice to the ASO Community on Rejection Action Petition Period for ICANN/IANA FY26 Operating Plan and Budget and ICANN FY26-30 Operating and Financial Plan

This message is sent on behalf of the NRO Secretariat. ----------- Summary ----------- The ICANN Empowered Community is the mechanism through which ICANN’s Supporting Organizations (SOs) and Advisory Committees (ACs) can organise, under California law, to legally enforce their community powers and hold ICANN accountable for its actions. The Address Supporting Organization (ASO) is the Decisional Participant in the Empowered Committee. The ICANN Board has approved the operating plans and budgets for IANA and ICANN for 2026, as well as the ICANN Operating and Financial Plan from 2026-2030. Should anyone wish to object to the ICANN Board's approval of these plans and budgets, they may send a Rejection Action Petition to the ASO Secretariat by 30 May 2025. During Rejection Action Petition Periods any individual may submit a petition to any Decisional Participant, seeking to reject the Board action.
