I think the problem is mainly caused by the mechanism to subscribe to the list. Because it's in the portal people add group contacts into the portal, then without thinking click the button to subscribe to the list, completely ignoring the 'discuss' bit and there we go. Perhaps, when the person adds an address to the discuss list via the portal it could generate an automated test mail to the address and then if there is a response disable that membership and flag this in the portal in red.
