I wonder given a worrying generality in NIS2 if I'd go a bit further. 

open and free source software , data and  hardware is a vital institutional platform and Model all stakeholders and  infrastructures depend on.

 Regulations including NIS2 promoting open markets and innovation in Europe and  globally need to support the  iteration of open technology at all levels and interactions that society depends.

EU Cybersecurity Act Consultation

The consultation provides an opportunity for stakeholders to contribute views on the future development of the EU cybersecurity framework, including ENISA’s mandate, certification schemes, and broader cybersecurity policy objectives.
