RIPE NCC response to the Commission adoption of the Digital Services Act

Dear colleagues, Today the RIPE NCC submitted a response to the European Commission’s proposal for the Digital Services Act (DSA). We feel that the Commission’s DSA proposal is generally well balanced, having maintained the key principles of the E-Commerce Directive, including the limited liability regime for online intermediary service providers, a prohibition on general monitoring obligations, and the country of origin principle. We also believe it includes proportionate thresholds for intervening with core functions or operations and that it tries to target those providers who are best suited to respond to notice and action requests while minimising the potential for collateral damage. However, we did ask for further clarification around the definition of online platforms, as this is something that we’re looking at with regards to RIPE Labs. Follow up from the Coop WG call on NIS 2 Directive

Dear members of the Working Group The Cooperation Working Group held a remote session last week, the archives of which have been shared to the list. It was clear during that session that there were concerns from members of the RIPE community, and that the timeline for making any formal response was very limited (with a deadline of 18 March). Unfortunately, despite some very active discussion during the session, there was not much further discussion on the list. However, the Working Group Co-Chairs felt that, while there is not agreed “RIPE community position”, it is important that the concerns raised should be conveyed to EU policymakers. To that end, two of the Co-Chairs (not including Achilleas, who has recused himself from this activity as an employee of the European Commission) have developed a response to the current open consultation that highlights the key concerns expressed in the remote session. The submission asks that EU policymakers work closely with members of the RIPE community to refine the NIS2 draft and address the concerns raised. Online discussion on the European Commission’s draft Directive on Security of Network and Information Systems (NIS2) - Tuesday 9 March

Staff from the RIPE NCC will give a brief overview of the key elements of the proposal and the potential implications for operators in the RIPE community (and the RIPE NCC itself). As well as a community discussion, this will also be an opportunity for the working group and its members to consider responding to the public call for comments that the Commission currently has open. Cooperation WG Chair Selection -co-chairs deliberation

Dear group, As reflected by the discussion in the list, the general feeling of not just the chairs but the list as well, is that we have two very good candidates. Unfortunately, as expressed by Jim, it wouldn’t make sense to go for 4 co-chairs. We were thus faced with a very difficult decision, as there also was no clear preference for either candidate during the discussion phase. In the end, and after a lot of deliberation, we decided to select Desiree as the new co-chair. We want to thank Dick for being a great candidate, and hope he will still be available in the autumn when we plan a second round of co-chair selection - and meanwhile we are also looking forward his active participation in the WG. Status update ITU discussions

Dear colleagues, Let me start by wishing you all a happy and healthy 2021. I would like to give you a quick update on the discussions that have taken place at ITU in the past few weeks, in particular with regards to New IP, also called FVCN. As you may recall from my earlier posts, there were two study groups seeking to establish "Questions" - the ITU equivalent of a working group - to study a new network architecture and protocol suite, that were positioned to replace or significantly amend the current set of Internet protocols and standards which are maintained by the IETF. Both study groups 11 and 13 held meetings in the week before Christmas. In those meetings, it again became clear that outside of the small group of initial proponents there was little support for the proposed work. And a large group of countries and sector members, including the European Commission, the 27 EU member states, the UK, US, Canada, Japan, as well as the RIPE NCC, GSMA and ETNO, all objected to the establishment of these Questions. The ITU-T processes require these decisions to be consensus based and the long and sustained opposition could only lead to the conclusion that there was no consensus on moving forward with these proposals. Subsequent to that conclusion and although the process technically allows for it, the meetings also failed to reach agreement to send these proposals for consultation of the member states. This now means that, after about a year of discussions, all options in the current process have been exhausted and effectively the topic has been put to rest. In fact, as the question was raised on whether the groups should continue to discuss the proposals, the meeting could not agree and again failed to reach consensus to do so. Further, as we now expect the WTSA-20 conference to be rescheduled to March 2022. A contingency plan has been put in place. As part of that, a revised set of Questions (excluding the ones the ones that failed to reach consensus) have now been forwarded to a meeting of the Telecommunications Standardisation Advisory Group (TSAG) for endorsement as the outcome of the discussions on future work. We expect that, with the endorsement of those agreed questions, we can leave the discussion about the work plan behind, and focus on those work items that fit within the remit of the Union and on which there is consensus that standardisation efforts by ITU-T are required and helpful to our industry. As a sector member of ITU-T, we will remain engaged with these and other study groups and update you on any relevant developments, also towards WTSA and other upcoming conferences such as WTDC and the next Plenipotentiary, which will take place in the autumn of 2022. RIPE NCC contribution to Dutch government consultation on regulating online content

Dear colleagues, The Dutch government recently held an open consultation asking members of the Internet community to give feedback on a report about online content regulation that was produced by the Advisory Council on International Affairs, which advises the government on foreign policy. We also state our support for the multistakeholder model of Internet governance and encourage the Dutch government to include technical communities in policy discussions. RIPE NCC Response to the EU’s Cybersecurity Strategy

Dear colleagues, Over the last few days, the European Commission has published a number of proposals and strategy documents that lay out its plans for the digital economy. These include the Digital Services Act (DSA), the Digital Markets Act (DMA) and a policy document outlining the European Union's Cybersecurity Strategy for the Digital Decade. We are currently working through these documents to assess their impact on our operations, the multistakeholder ecosystem and the Internet at large. However, we’ve already seen that the cybersecurity strategy document makes a reference to our role as one of the DNS root server operators based in the EU, with a plan to "assess the role of these operators in guaranteeing that the Internet remains globally accessible in all circumstance.” We have issued a short public response to this point in particular, which you can find here: https://www.ripe.net/publications/news/announcements/ripe-ncc-response-to-t… Any feedback you might have on this statement is welcome. We will follow these proposals as they move through the legislative process and use the EU’s consultation processes to provide further input, as we continue to work with the European Commission, member states and other stakeholders to share our insights and expertise.
