The RIPE NCC produces these country reports in order to inform discussion around Internet development among technical communities and decision makers throughout our service region. Dear Coop WG members 1. The nomination period has now expired, and as far as we know, there have not been any nominations. 2. We didn’t have any new candidates standing for an election this time. 3. We have only been contacted by people not intending to be candidates but have previously considered the role. We would like to thank them for this feedback. 4. We suppose that WG silence is a sign that people are happy with Julf & Achilleas continuing, but would of course prefer a positive affirmation, so we encourage you to confirm your approval (louder than the silence) on the list. 5. Update on NIS2: European Parliament votes to exclude DNS root servers

Dear colleagues, Last night the European Parliament's Committee on Industry Research and Energy (ITRE) approved a set of amendments on the NIS 2 proposal, with a majority of 70 votes to 3 and one abstention. The MEPs also voted in favour of opening the negotiations with the other institutions. https://www.europarl.europa.eu/news/en/press-room/20211022IPR15610/cybersec… Crucially for this community, these amendments include changes to the way the DNS service providers are included and importantly, the parliament's proposal is to remove the DNS root-servers from the scope of the proposed directive. We are pleased to find the parliament and its rapporteur, Mr Groothuis, agree with our views that the DNS root and the root-servers should not be subject to (national) legislation, quoting the justification from his report: "Root name servers should be out of scope; regulating them is contrary to the EU’s vision of a “single, open, neutral, free, secure and un-fragmented network” and could encourage and empower states advocating for a top-down, state-controlled Internet governance approach, instead of the multi-stakeholder approach." To be clear, this is just one step in the legislative process, but a very important milestone. Meanwhile on the side of the EU member states ("EU Council") The Horizontal Working Party on Cyber Issues is also busy discussing their views and find consensus on the Council's position. Once that is done, the negotiations between Parliament, Council and Commission can start and develop a final compromise text. Although these meetings are closed, we have been receiving information that the exclusion of root is being discussed. We hope to find that the member states also support our view that matters concerning the root-server operations should be addressed in a multistakeholder setting and will agree to exclude the DNS root-servers from the proposal. EU Update: LIBE Committee votes on NIS2 and CER

Dear colleagues, I'd like to provide a short update on some of the European legislative proposals which we are tracking, especially as these proposals probably have wider implications for the Internet industry and the members of this community. This update concerns decisions made by the European Parliament's commission on Civil Liberties (LIBE) regarding amendments on two different proposals: One being a new set of rules for providers of critical infrastructure, or "resilience of critical entities" (proposal 2020/0365). The other set of amendments concerns the proposal for a new Network and Information Security directive, or NIS2 in short (proposal 2020/0359). Important in the amendments on the critical entities draft is that MEPs are proposing to alter the scope of the directive and suggest to include language that defines "European significance" for entities that offer a similar service in at least 3 member states. With agreement to this set of amendments the parliament has now adopted its position and is ready to enter the next stage of the process, the so called trilogue in which a final text will be negotiated between the European Commission, the European Parliament and the European Council (member states). A press release, which has references to the directive and the proposed amendments is available at https://www.europarl.europa.eu/news/en/press-room/20211006IPR14307/essentia… The same committee also discussed and agreed to a set of amendments concerning the NIS2 proposal. However, in this case the parliament's ITRE committee is leading on the dossier. This means that the proposed changes from the LIBE committee will be brought as input to the ITRE deliberations and have to be merged with theirs to form a final set of proposed changes that the ITRE committee will then vote on. This final vote is now scheduled for 28 October. Unfortunately not all the amendments are publicly available but the main opinion of the LIBE committee, which contains a large set of them, can be found at https://www.europarl.europa.eu/doceo/document/LIBE-PA-693822_EN.pdf We will continue to monitor the developments as the ITRE proposed amendments also contain changes in language and scope, which would remove the DNS root-servers from the scope of the directive. As I explained above, the parliamentary vote on amended text is only the first step towards the final negotiations to find a compromise. We believe however that, if the ITRE committee agrees to exclude the DNS root servers, it would mark a significant milestone. Such a position would provide a great starting point for the trilogue. Where we hope the other parties involved will also agree that the operations of the DNS root name-servers should should be excluded from the scope. On the grounds that core functionality like this, having global significance, should be left to the multistakeholder model of Internet governance. UN-IGF DC-ISSS survey into Internet of Things security and policy

The survey is a part of research currently undertaken within the UN-IGF’s Dynamic Coalition Internet Standards, Security and Safety’s Working Group Security by design – Internet of Things. For clarity, a short introduction. The Dynamic Coalition on Internet Standards, Security and Safety (DC-ISSS) brings together key stakeholders from the technical community, civil society, government policymakers, regulators, and corporate and individual adopters, with the shared goal of making online activity and interaction more secure and safer by achieving more widespread and rapid deployment of existing Internet standards and ICT best practices. Making the internet more secure: An invitation

Dear colleagues, On Monday 28 June at 11.30 UTC (13.30 CET) the Dynamic Coalition on Internet Standards, Security and Safety presents itself, its three working groups that started in 2021 and their respective workplans and mission statements. You are kindly invited to join this virtual workshop. A more secure and safer Internet, ICT and IoT, is in the interest of every end user. Whether corporate, public services or individuals, all end users should be adequately protected by state of the art security, available in the form of Internet standards and ICT/IoT best practices concerning security. Presently these standards and best practices are seriously underused, leaving the world at large, and its private and public interests, less protected than is currently possible. The DC-ISSS aims to ensure that standards and best practices play their full role in addressing these challenges through establishing the conditions for their wider, more effective and more rapid adoption by key decision-takers in the implementation chain. Said deployment is of direct interest to your organisation. Closing the gap between the theory and the practices of digital security is the main theme of the DC’s working groups. The gap between the theory of roadmaps on IoT security and secure-by-design devices and sensors. The gap between current tertiary schooling in cyber security curricula and the demands industry and other employers make on, not only, educational facilities but also those graduating there. The gap between the necessity of a more secure digital environment and the lack of active, security demand and thus offer of security. Deployment equals a significantly higher level of protection against the exploitation of vulnerabilities, hacks and extortion. It’s in your interest. In this session the current three working groups: security by design – Internet of Things; education and skills and; procurement, supply chain management and the creation of a business case for deployment will present their respective plans for 2021. Dear Colleagues, The UK Chapter of the Internet Society recently held a Webinar and Roundtable on the new Draft UK Online Safety Bill and several people suggested that I post an announcement on the RIPE cooperation WG mailing list, once the Webinar's recording was made available. As a reminder, the Bill contains several far reaching proposals including some suggesting that Encryption should be weakened through various methods. This has generated much pushback from UK entities and the Internet Society has drafted an online letter to members of the UK Parliament, co-signed by dozens of organisations, that “End-to-End Encryption keeps us safe”. ENISA Survey: "Cybersecurity Consumer Outreach Practices"

Dear colleagues, I've been asked to encourage you to respond to a short survey by ENISA, which will take approximately 15 minutes of your time. The European Electronic Communications Code (EECC) contains some provisions regarding outreach to costumers and consumers regarding potential cybersecurity threats security incidents and what they can or need to do. Or in the text of the EECC itself (Art, 40, par. 3): “Member States shall ensure that in the case of a particular and significant threat of a security incident in public electronic communications networks or publicly available electronic communications services, providers of such networks or services shall inform their users potentially affected by such a threat of any possible protective measures or remedies which can be taken by the users. Where appropriate, providers shall also inform their users of the threat itself.” Amongst its goals, the survey aims to identify: • Effective solutions and good practices of the cybersecurity consumer outreach by electronic communication providers. • Methods of authorities for supporting the development of customer outreach on cybersecurity. If you have any examples to share, please participate in the survey. Although this survey is organised by ENISA, it is not uncommon for the results of these surveys to form the basis for legislative proposals by the Commission. In that context it is always useful to provide input about industry practices and position in these early stages and be able to inform policy makers about the things that work and the things where change might be needed. Update on NIS 2: Proposed amendments by the Parliament alter scope on (root) DNS

Dear colleagues, We'd like to inform you that some changes have been proposed to NIS 2 that would accommodate some of the concerns raised by the RIPE NCC and the RIPE community. As a quick recap: the European Commission proposed an update to the Network and Information Security Directive, commonly referred to as NIS 2, which would bring the DNS root servers into scope of the directive, resulting in regulatory oversight of the DNS root server operators. Following our response on the NIS 2 proposal in the public feedback process, we reached out to a number of parties involved in the legislative process, including some members of the European Parliament, drawing attention to our concerns. The ITRE committee, which is leading this dossier in the European Parliament, yesterday published its initial report listing a number of proposed amendments. We are happy to see that it has taken on board the concerns we and other community members have raised. In particular, the committee proposes amending the scope of the directive to include: "authoritative domain name resolution services as a service procurable by third-party entities”. We realise this leaves a substantial part of the DNS in scope; however, this change would address the concerns we raised in our response by removing from scope: - DNS root operations - Small and non-commercial operators, such as people running their own DNS servers We are pleased to see these amendments and appreciate the rapporteur, MEP Groothuis, addressing our concerns. RIPE NCC Response to the Commission adoption of the Critical Entities Resilience Directive

Dear colleagues, The RIPE NCC once again submitted a response to an open consultation held by the European Commission, this time on the adoption of the Critical Entities Resilience (CER) Directive. The CER Directive is a proposed update to the European Critical Infrastructure (ECI) Directive that seeks to protect critical infrastructure within the EU from natural or man-made disruptions, and has been expanded to cover new sectors, including digital infrastructure. The CER Directive is based largely on the definitions set out in the proposed NIS 2 Directive (which we responded to in March), and stipulates how member states will be responsible for protecting those critical entities operating within their borders. Following our NIS 2 response, in which we asked that root server operators be excluded from scope, we urged the Commission to ensure consistency between the NIS 2 and CER Directives to safeguard against the possibility of being exempt from NIS 2 but somehow included in CER. RIPE NCC response to the Commission adoption of the Digital Services Act

Dear colleagues, Today the RIPE NCC submitted a response to the European Commission’s proposal for the Digital Services Act (DSA). We feel that the Commission’s DSA proposal is generally well balanced, having maintained the key principles of the E-Commerce Directive, including the limited liability regime for online intermediary service providers, a prohibition on general monitoring obligations, and the country of origin principle. We also believe it includes proportionate thresholds for intervening with core functions or operations and that it tries to target those providers who are best suited to respond to notice and action requests while minimising the potential for collateral damage. However, we did ask for further clarification around the definition of online platforms, as this is something that we’re looking at with regards to RIPE Labs. Follow up from the Coop WG call on NIS 2 Directive

Dear members of the Working Group The Cooperation Working Group held a remote session last week, the archives of which have been shared to the list. It was clear during that session that there were concerns from members of the RIPE community, and that the timeline for making any formal response was very limited (with a deadline of 18 March). Unfortunately, despite some very active discussion during the session, there was not much further discussion on the list. However, the Working Group Co-Chairs felt that, while there is not agreed “RIPE community position”, it is important that the concerns raised should be conveyed to EU policymakers. To that end, two of the Co-Chairs (not including Achilleas, who has recused himself from this activity as an employee of the European Commission) have developed a response to the current open consultation that highlights the key concerns expressed in the remote session. The submission asks that EU policymakers work closely with members of the RIPE community to refine the NIS2 draft and address the concerns raised. Dear group, As reflected by the discussion in the list, the general feeling of not just the chairs but the list as well, is that we have two very good candidates. Unfortunately, as expressed by Jim, it wouldn’t make sense to go for 4 co-chairs. We were thus faced with a very difficult decision, as there also was no clear preference for either candidate during the discussion phase. In the end, and after a lot of deliberation, we decided to select Desiree as the new co-chair. Status update ITU discussions

Dear colleagues, Let me start by wishing you all a happy and healthy 2021. I would like to give you a quick update on the discussions that have taken place at ITU in the past few weeks, in particular with regards to New IP, also called FVCN. As you may recall from my earlier posts, there were two study groups seeking to establish "Questions" - the ITU equivalent of a working group - to study a new network architecture and protocol suite, that were positioned to replace or significantly amend the current set of Internet protocols and standards which are maintained by the IETF. Both study groups 11 and 13 held meetings in the week before Christmas. In those meetings, it again became clear that outside of the small group of initial proponents there was little support for the proposed work. And a large group of countries and sector members, including the European Commission, the 27 EU member states, the UK, US, Canada, Japan, as well as the RIPE NCC, GSMA and ETNO, all objected to the establishment of these Questions. The ITU-T processes require these decisions to be consensus based and the long and sustained opposition could only lead to the conclusion that there was no consensus on moving forward with these proposals. Subsequent to that conclusion and although the process technically allows for it, the meetings also failed to reach agreement to send these proposals for consultation of the member states. This now means that, after about a year of discussions, all options in the current process have been exhausted and effectively the topic has been put to rest. In fact, as the question was raised on whether the groups should continue to discuss the proposals, the meeting could not agree and again failed to reach consensus to do so. Further, as we now expect the WTSA-20 conference to be rescheduled to March 2022. A contingency plan has been put in place. As part of that, a revised set of Questions (excluding the ones the ones that failed to reach consensus) have now been forwarded to a meeting of the Telecommunications Standardisation Advisory Group (TSAG) for endorsement as the outcome of the discussions on future work. We expect that, with the endorsement of those agreed questions, we can leave the discussion about the work plan behind, and focus on those work items that fit within the remit of the Union and on which there is consensus that standardisation efforts by ITU-T are required and helpful to our industry. As a sector member of ITU-T, we will remain engaged with these and other study groups and update you on any relevant developments, also towards WTSA and other upcoming conferences such as WTDC and the next Plenipotentiary, which will take place in the autumn of 2022. RIPE NCC contribution to Dutch government consultation on regulating online content

Dear colleagues, The Dutch government recently held an open consultation asking members of the Internet community to give feedback on a report about online content regulation that was produced by the Advisory Council on International Affairs, which advises the government on foreign policy. RIPE NCC Response to the EU’s Cybersecurity Strategy

Dear colleagues, Over the last few days, the European Commission has published a number of proposals and strategy documents that lay out its plans for the digital economy. These include the Digital Services Act (DSA), the Digital Markets Act (DMA) and a policy document outlining the European Union's Cybersecurity Strategy for the Digital Decade. We are currently working through these documents to assess their impact on our operations, the multistakeholder ecosystem and the Internet at large. However, we’ve already seen that the cybersecurity strategy document makes a reference to our role as one of the DNS root server operators based in the EU, with a plan to "assess the role of these operators in guaranteeing that the Internet remains globally accessible in all circumstance.” We have issued a short public response to this point in particular, which you can find here: https://www.ripe.net/publications/news/announcements/ripe-ncc-response-to-t… Any feedback you might have on this statement is welcome. We will follow these proposals as they move through the legislative process and use the EU’s consultation processes to provide further input, as we continue to work with the European Commission, member states and other stakeholders to share our insights and expertise. New Internet Country Report: Gulf Region

Dear colleagues, We’ve published the latest in our series of country reports, this time looking at the Internet landscape in eight countries in the Gulf region. This is the sixth such country report that the RIPE NCC has produced as part of an ongoing effort to support Internet development throughout our service region by making our data and insights available to both local technical communities and decision makers. The report looks at the state of the Internet in the Gulf region, including its market landscape and regulatory environment, Internet number resources and opportunities for growth, regional connectivity, routing and routing security, and the operators and paths providing international transit into the region. We also reach a number of conclusions about what is needed to further develop the Internet in the Gulf region. As stated in the WG session of RIPE81, we are inviting anyone who is interested in being a co-chair of the WG to contact me and/or Achilleas (preferably at cooperation-wg-chairs(a)ripe.net). We think it would be useful to have a third co-chair, and that also helps if one (or both) of us current chairs have to step down. If there are multiple people interested in being co-chairs, we will start a proper election procedure, with both me and Achilleas up for re-election - we might do that anyway, as good practice.
