Well, my last email actually shows some issues that the CoC should take into consideration, as this kind of misunderstanding can easily happen in a public mailing list. Anyway, I think there is no need to continue this discussion, just to see what documents allow a TF to be a closed group. That's the key in this specific case, but can happen in other "closed" grops as well.
