I am hoping there are some lawyers or legal experts in this WG.
they are even less likely to advise you than random dilettantes
I would like to know if it is possible for me, as a private individual, to bring a civil case against an End User for damages because of some abusive behaviour?
in most jurisdictions, of course
To do so I would need to know who the End User is. A consequence of the policy change 2023-04 means that the End User details may not be documented in the RIPE Database. As far as I can determine (from googling) a court order can only be served on the LIR to identify the End User by an LEA in a criminal case.
in England and Wales that is not the case ... what you would need is called a "Norwich Pharmacal Order"
I have tried to find out what I can do in a civil case. Most of the information is such heavy legal stuff, I don't have the training to interpret it. For example:
if you are going to proceed you will need expert help. That will cost $$$$ ... face up to that immediately, and get the answers you need from people qualified to provide them, and then use this list for its proper purpose.
I have no intention of bringing an action against anyone. I was trying to determine if it is possible for someone to do this. As Brian confirmed recently, this list is still the place to discuss abuse issues. So my question does fit the proper purpose of this list...unless the community doesn't agree with Brian??? cheers denis
